Accused triggerman to appear in court

The accused triggerman in the 2007 shooting death of state Constable Robert Bailey in Lincolnville is scheduled to appear in court this morning.

Walter Fayall III, 27, of St. Stephen, is expected to make a 9:30 a.m. appearance before Circuit Judge G. Edward Welmaker at the Charleston County judicial center, according to the 9th Circuit Solicitor's Office. Prosecutors offered no clue as to the reason for the appearance or what might happen.

Fayall is charged with murder, kidnapping, possession of a firearm during a violent crime, possession of a stolen firearm and grand larceny. Prosecutors previously announced their intention to seek the death penalty for the triggerman.

Bailey, 67, a retired former Dorchester County deputy and Charleston police officer, worked as an unpaid volunteer patrolling Lincolnville streets. He vanished late May 14, 2007, while pulling over a Chevrolet Caprice on Greenwood Street, authorities have said.

Investigators have said that Fayall, a federal fugitive, and his girlfriend, Asia Prioleau, 22, were inside the car. They lived in a house next to the spot where Bailey stopped them.

Blood, the constable's cap and two guns were found nearby. His patrol car was found burned in the Sangaree area. Authorities launched a massive five-day search and arrested five people before unearthing Bailey's body a few miles off Interstate 26 in Orangeburg County.

26-year-old wanted in double shooting

The Colleton County Sheriff's Office issued a warrant Monday for a 26-year-old Walterboro man in connection with an early morning shooting of a man and a woman at a local nightclub.

Desi Antwuan Elliott of Bethea Street is wanted on two counts of assault and battery with intent to kill and one count of possession of a firearm during the commission of a violent crime, Sheriff George Malone said in a news release.

Elliott, aka "Smoke," is 5 feet 10 inches tall and 180 pounds with tattoos on both arms. He is considered armed and dangerous, and anyone who comes in contact with him or know of his whereabouts should contact authorities, the release said.

Shonda Donaldson, 35, and Cheumalt Omega Gathers, 26, were wounded by gunfire about 2 a.m. Monday at the Apollo Lounge on Rivers Street just outside Walterboro, the release said.

Donaldson, who was shot in the arm and the side, was taken to a Charleston-area hospital and was in stable condition Monday afternoon, the release said. Gathers, who was shot in the arm, was treated and released from Colleton Regional Hospital.

Sheriff's deputies stopped a car carrying one of the victims from the lounge; the other victim was taken to the hospital by private car.

It's the second shooting to occur at the nightclub since Dec. 13, when a man was shot in the arm, and the third recent shooting to take place on Rivers Street. On Jan. 17, a man and a 12-year-old girl were struck by gunfire at a Rivers Street home. Both the man and the girl survived.

No one has been charged in that case. Investigators have been working to stem a wave of violence in the area that is believed to be gang-related.
